Kinsman attorney John Clune said his client will receive more than $250,000, adding that FSU is using that breakdown to justify its payment. The settlement also includes Florida State's five-year commitment to sexual assault awareness, prevention and training programs, and the school agreed to publish annual reports on those programs. Kinsman said she was drunk at a Tallahassee, Florida, bar in December 2012 when Winston and others took her to an apartment, where she says the quarterback raped her. Winston has said the two had consensual sex. In January 2015, Kinsman filed a Title IX lawsuit alleging that Florida State violated federal law when school officials showed a "deliberate indifference" to her allegation. She claimed the school fostered a "hostile educational environment" and refused to investigate her allegation as federal Title IX laws dictate. She left the university after the allegation became public in November 2013."I will always be disappointed that I had to leave the school I dreamed of attending since I was little," Kinsman said in a statement. "I am happy that FSU has committed to continue making changes in order to ensure a safer environment for all students."The case was scheduled to begin in U.S. District Court for the Northern District of Florida in July 2016 after a judge in August 2015 denied Florida State's motion to dismiss the lawsuit. The lawsuit alleged that the athletics department and Fisher deliberately withheld the allegation from the school's Title IX coordinator and Office of Student Rights and Responsibilities. Florida State president John Thrasher said the principal reason for the settlement is to avoid continuing litigation expenses."Although we regret we will never be able to tell our full story in court, it is apparent that a trial many months from now would have left FSU fighting over the past rather than looking toward its very bright future," Thrasher said in a statement. "We have decided to instead move forward even though we have full faith that the ultimate outcome of a trial would have been consistent with the previous law enforcement investigations and retired Supreme Court Justice Major Harding's findings in the student conduct hearing." Clune said the settlement helped accomplish Kinsman's two goals from filing the lawsuit."No. 1, she wanted to hold FSU accountable and it has happened both publicly and financially, and the other is to have an impact on FSU's campus and make it a safer place for female students," Clune said. "She thinks [Florida State's initiatives] is a good start, but there is definitely more work to be done. They're on the path."Kinsman filed a civil suit against Winston, who filed a countersuit. She also told her story publicly in a documentary.The Tampa Bay Buccaneers selected Winston with the No. 1 overall pick in the 2015 NFL draft. She wasn't able to identify him until she saw him in school later.The rape kit confirmed it was his DNA, so the timeline doesn't match up to those FSU fans accusing her of trying to exploit a popular star athlete. It still might not be enough to prove he raped her, criminally, but the motive that she's a gold digger just doesn't pan out. Talahassee police and FSU deserve everything they get. She was drunk at the bar, he came in and helped get her away from a creepy guy, took her home and took advantage of her. I think that's just a hit job perpetuated by FSU fans.She wasn't able to identify him until almost 2 weeks after the incident. The rape kit matched his DNA. If she knew he was a football player when she had sex with him, it wouldn't have taken that long. Also considering she reported the rape the next day, that kills the narrative she was trying to frame him specifically. She didn't run into him and think "that's the guy I slept with, now that I know he's an athlete, I'm going to frame him". It just doesn't make sense.I don't know what happened. I do know that FSU and the Tallahassee PD should have taken it more seriously. I sincerely hope none of these scumbags making light of this situation don't have daughters or wives. Just speaking freely here. A lot of college athletes have real issues. I went to a large university and I came into contact with or had classes with athletes that thought they were "Gods Gift." Let me tell you that these were the guys that never saw the field in a lot of cases. I don't want people to think that means you are guilty. There are plenty of athletes that are good guys. I don't want them to all be branded.I saw part of The Hunting Ground on CNN. It was really sad to hear University faculty talk about being tough on rape, but several let athletes play out their season and eligibility before kicking them out of school due to issues they had with other students. You see the same thing is society, people that hold money, power or perceived value value get a different set of rules. That is not justice. I will admit that I felt as though he was probably guilty, but I will also admit to not doing any research on it either. It's funny how a little research paints a different picture. I do not condone rape, nor do I condone cover-ups. In this matter, I fully believe that this lady felt like this was going to get back to her boyfriend because the one guy recorded some of it. She felt like she would have to do something drastic to make it seem like she was taken advantage of. The facts clearly point out that she fabricated the whole rape, and is trying to cover up her own error in judgment in cheating on her boyfriend. It would be easy to point out Winston's track record of stupidity, but accepting crab legs from somebody improperly and shouting an internet fad in a cafeteria are dumb things that kids do. I wholeheartedly believe that he was just in the wrong place with the wrong person. Her story changed every time there was a hole. She said she was impaired, but within two hours of the incident she has the equivelent of half of a beer in her system. The tox screen was negative. She later tried to say she hit her head, and coincidentally blacked out during a 5-10 minute ride to a guy who wasnt her boyfriend's apartment. Her friend's account of the night corroborated the fact that she willingly left with them. What was she planning to do with three males she met at a bar between 1am and 3am. Like I said, I am disgusted by rapists, and even moreso with those who cover them up, but if you look at the facts in this one it's hard to say that anything outside of consensual sex happened. Who knows if this would have even been an issue if his teammate hadn't filmed some of this encounter. We might not have even had to wonder about any of this.
