Trouble Posted June 10, 2015 Share Posted June 10, 2015 As the trial challenging the ability of Saints owner Tom Benson to change his will to bequeath his NFL and NBA teams not to a daughter and her two children but to his wife continues, a question lingers regarding whether Benson will testify in the case.Via Andy Grimm of the New Orleans Times-Picayune, Benson’s lawyers have asked the court to exclude his testimony. The lawyers representing the family members challenging the new will want to force Benson to answer questions under oath.Asked last week by reporters whether he’ll testify in the case, Benson said, “I don’t know. I’m ready.”It’s hard to imagine Benson not testifying when the core question is his ability to make decisions about his finances and to otherwise care for himself. And it’s tempting to think that his lawyers fear it won’t go well, given that they want to keep him off the stand — and that the lawyers for his family members want to put him there.If he doesn't testify is could be seen as him hiding his current condition. There's zero need for him to appear before the court.Thats 1 view. As i pointed out there is the other view that he could be hiding something if he does not appear. Who payed for the specialist? Honestly i dont know. But if benson paid for them then if could be questioned if thats why they favor him.Ive had many doctors questioned over my health. Even after a brain surgery insurance re questioned my doctor about it. Like he was lying about doing it. Its the only reason they would want him on the stands. Unless they have a card to play to prove he isnt sane.Say their is a 50/50 chance the judge could go either way with the findings. getting him on the bench could sway the judge in their favor. of course you wanna increase the odds if you can and Benson side wants to decrease theirs while increasing theirs.
