Prosecutor: Vick's Virginia dogfighting trial can wait until release from prison

RICHMOND, Va. -- A prosecutor says the state trials of Michael Vick and three co-defendants on dogfighting charges will be delayed until they are freed from federal prison.

Commonwealth's Attorney Gerald Poindexter says it's not worth the expense for Surry County to get the men from prisons in different states for trial and escort them back later.

Vick and the other defendants face charges of beating or killing dogs, or causing dogs to fight other dogs, and engaging in or promoting dogfighting.

The former Atlanta Falcons quarterback is serving a 23-month prison sentence after pleading guilty to federal charges in a dogfighting operation. The others received sentences of up to 21 months in prison.

One defendant, Tony Taylor, has already been released. His state trial is scheduled for July 26.

Guess the Tony Taylor case will shed a little light on if the state charges add up to squadiddle.

I am no lover or hater of Vick, but it still seems to me his is essentially being charged for the same crime twice. Terminology aside.

The state charges are different from the federal charges. Vick is in prison for federal racketeering and intra-state gambling - not dog-fighting.

Dog-fighting itself is where the state comes into play, and that's what awaits Vick in the State of Virginia.

I know and have accepted the fact that Vick is not coming back, but waiting until he gets out to make him go right back, is just piling on and not right. Even Poindexter said dogfighting is BARELY a felony in Virginia. How much time could they really add?

This is one of the first things Poindexter has said that actually makes sense...

Once an inmate is in federal custody, the feds have an administrative rule that says they are not required to return the inmate to the state to face charges until the inmate has finished the federal time (and this is why, in most cases, all state charges are resolved and sentences served before the feds get the inmate).  It appears the feds didn't simply tell Poindexter he couldn't have his defendant back...they told him they would be happy to send Vick his way if he was willing to pay for it.  In other words, the feds were going to charge the State all costs of transporting Vick, having the U.S. Marshall's guard him, etc., and the price was going to be steep. 

What isn't clear from the article is if a "hold" has been placed on Vick by the State.  If that has happened, then Vick won't be out of custody once he serves his time, he'll be transferred to the State's custody.

i agree. poindexter has proven already that he wont go after vick. heck i would even say it's poindexters faults the feds got involved in the first place. if you are going to cover up for someone, don't brag about it to the national media.
